Insufficiency of the “in claris non fit interprepatio” clause in the brazilian experience: repercussions on family law

Abstract

The present study aims to answer the following question: is the constantly elaborating of new laws the only way to deal with the successive changes experienced by Family Law; or would it be possible to opt for a hermeneutic path, aimed at apprehending normative statements in the face of cultural and sociological changes experienced from a new meaning of family, allied to the extrapositive moments? In the light of questions of this order and, taking as a subsidy the studies presented by Pietro Perlingieri in his valuable work " O direito civil na legalidade constitucional", this work seeks to make reflective considerations about the (in)sufficiency of the brocardo "in claris non fit interpretatio" in constitutional legality, notably in view of the conceptual turn that Family Law has been going through, exposing reasons and grounds for the safeguarding (or not) of the clause in the national legal system.
