Abstract

This article addresses the impacts of post mortem assisted human reproduction on Succession Law, given that the Brazilian legal system provides that people born or conceived at the time of the opening of succession are entitled to succeed. Throughout the text, the issue of the holder of the frozen genetic material for its use after death was addressed, in light of the decision of the Superior Court of Justice in Resp nº 1918421/SP. Thus, it was reflected on the inheritance rights of the child who is born after the death of the parent, in consideration of the principles of equality with other descendants and that of the security of legal relationships.
