Personal data leakage and civil liability: congruences and incompatibilities between the brazilian Consumer Defense Code and the general personal data protection law

Abstract

This paper aims to analyze the theoretical and legal frameworks that link consumer and data processing relations. Through unobtrusive research on data breach situations and their possible repercussions to the legal sphere, the research question inquires whether there is a common reading of application and reasoning between Brazilian Consumer Code and Brazilian General Data Protection Law. The particularities that involve consumer and data processing relations, the vulnerabilities of their inner subjects, as well as the civil liabilities mechanisms applied are some of the points investigated in both laws.  In conclusion, the mere automatic application of the fundamental logic of legal institutes forged to promote the protection of consumers to situations of data processing could reveal itself as an undesirable practice that could hinder the regulation of data processing operations in Brazil.
