Parental civil responsibility: historical evolution and the possibility of its extension after the children’s full capacity

Abstract

The research aims to analyze the historical evolution of civil liability of parents in the Brazilian legal system and the possibility of extending it, exceptionally, to parents even after the acquisition of full capacity of children. The Civil Code of 2002, among one of its main novelties, significantly expanded the institute of objective civil liability, influencing indirect civil liability. Regarding the possibility of its extension, in special situations, after the attainment of full capacity of the children, it was found that this debate has already reached the second instance, with a favorable decision in this regard, as we will analyze. It concludes that it is possible to hold parents responsible for unlawful acts committed by capable children. The method used is hermeneutic, arising from the analysis of the legislation, doctrine and jurisprudence.
