Abstract

The article will examine the "new" category of existential contracts, provisionally conceptualized as those in which the interest of at least one of the contracting parties not to return to profit, studying its contextualization and effects. For a better study, we will study the theme of functionalization of law, the effectiveness of fundamental rights in private relationships and the passage of freedom of choice for private autonomy.
