Emotional abandonment and the personality rights: a rereding in face of the evidentiary need for damages and the duty of family interaction

Abstract

The present paper focuses on a rereading of judicial decisions related to emotional abandonment and the form of its civil liability. It seeks through the hypothetical-deductive method and in jurisprudential bibliographic research to understand the consequences of abandonment and the damages caused to children and adolescents, and their reflexes in adulthood, as well as all the complexibility that permeates the paternal-maternal-branch relations. It is emphasized, consequently, that emotional abandonment is a damage to the psychic structure of children that can never be repaired in its entirety, but that compensation is a measure that is imposed, since it is an unlawful act. It is concluded that the breach of family interaction duty generates an injury on the personality rights of the abandoned person, as a damage in re ipsa, which has not been glimpsed by the Judiciary that has required, in many cases, the effective evidence of damage.
