Extrajudicial socioaffective filiation recognition: an analysis from the perspective of the right to access justice

Abstract

The purpose of this article is to analyze the institute of socioaffective filiation, specially the innovative possibility of its recognition in the extrajudicial area regularized by Provisions 63/2017 and 83/2019 of the National Council of Justice. In the Brazilian scenario, the Federal Constitution of 1988 was paradigmatic in introducing principles and fundamental rights to family relationships, implicitly bringing affectivity as a vector of these relationships. The study uses Popper’s epistemological perspective, employing tests of refutation and falsification of the circumstances motivating the alteration of Provision 63/2017, in particular the 12 (twelve) year old barrier now imposed by Provision 83/2019. It seeks to verify whether this age limit presents itself as an obstacle for this portion of the population to access justice.
