Decision Support: instrument to support the exercise of legal capacity of persons with disabilities established by the Brazilian Law of Inclusion (Law n. 13.146/2015)

The United Nations Convention on the Rights of Person’s with Disability (UNCRPD) and Brazilian Law of Inclusion (Law n. 13.146/2015) adopted the supported decision making to enable people with disability to enjoy autonomy and inclusion. Anyone can apply for support. But the alternative is more suitable for those people who have legal capacity and suffer some difficulty to make right choices, due to an intellectual disability, acquired brain injury, psychosocial disability or advanced age, for example. This paper analyzes the juridic aspects of supported decision-making in Brazil, identifying its particularities in relation curatorship.
