Abstract

The following article intends to reveal and systematically scrutinize the constitutional provisions concerning private property in Brazilian Law, thereby collaborating to a wide comprehension of such right in its constitutional dimension. Private property is thus presented as a legal institution, rather than as a conceptual category, despite the risks inherent to this approach. The understanding of property rights as legal institutions allow its holistic comprehension, in a civil-constitutional perspective.
