The image formed through artificial intelligence as an object of civil law protection

Abstract

This article aims to analyze the concept of Personality Rights in the face of new artificial intelligence and deep fake technologies, especially with regard to deceased people placed in situations that, due to their life story, would probably not be repeated if they were alive. The general objective is to analyze the concepts of Personality Rights in the context of new technologies. As specific objectives we have the analysis of the protection of Personality Rights in Brazilian Civil Law and whether this protection is adequate to safeguard image and honor with the advent of artificial intelligence. To this end, it was analyzed the advertisement celebrating the 70th anniversary of the German company Volkswagen in Brazil, with participation of the singer Maria Rita and the artificial intelligence reproduction of her mother, also a singer, Elis Regina, who died in 1982. As a methodology, this article used a bibliographical review applying the hypothetical-deductive method, having reached the conclusion that the traditional concepts involving Right to the image are not sufficient to safeguard Personality Rights in the face of new technologies of artificial intelligence.
