Duties in traffic: the essential role in tort law

Abstract

If in an initial period of systematizing tort law, coinciding with the modern Enlightenment and jus-rationalist period, the violated right was placed at the center of the tort model, the subsequent evolution of the institution has shown us the importance of conceptualizing duty. Duties in traffic occupy an essential role in tort law. Until nowadays, these duties have been thought in their relationship with unlawfulness. In the following pages, we will seek to understand to what extent they also play a fundamental role at the level of causation, now understood in terms of objective imputation.
