An approximation between the perspective of the Superior Court of Justice on the exhaustiveness of the ANS List and Law n° 14.454/2022

Abstract

This paperanalyzes the understanding of the Superior Court of Justice regarding the taxation of the ANS List based on the Appeal for Embargoes of Divergence in Special Appeal – EREsp 1,886,929 and 1,889,704 and its compatibility with Law 14545/2022. In addition to the analysis of the judgment and the new law, it also considers the position established in a vote delivered in August 2023 by Minister Nancy Andrighi, of the STJ, that the thesis of the exhaustive list was overcome, which demonstrates the existence of problems surrounding the possibility of conciliation between the STJ's position and Law 14,454/2022. In this sense, verifying the compatibility of legal changes in relation to the STJ's understanding, considering the problem highlighted by Minister Nancy's recent vote, is the contribution of this research. From the presentation of the legislative changes brought about by Law 14,454/2022, among them, the establishment of the ANS List as a basic reference, the research brings together legislative innovations and the jurisprudential understanding established within the scope of the Superior Court of Justice. The research has a delimited object which, in turn, is investigated by the hypothetical deductive method, based on bibliographic and jurisprudential collection.
