Busca-se sublinhar que, diante do inadimplemento absoluto, nasce para o credor o direito potestativo de optar entre a resolução da relação obrigacional e a execução pelo equivalente. Neste caso, a relação obrigacional não se desfaz, mantendo-se, para ambas as partes, todas as obrigações contratuais, razão pela qual o credor deverá executar <em>in natura</em> a prestação que lhe incumbe, e poderá se valer das garantias do crédito eventualmente prestadas. Procura-se demonstrar, ainda, que o equivalente não se confunde com as perdas e danos; trata-se de somas devidas a títulos diferentes, autônomas entre si. Por essa razão, sustenta-se a possibilidade de cumulação do equivalente com a cláusula penal compensatória, bem como o direito de o credor requerer seu pagamento mesmo em presença de cláusula de não indenizar. Por fim, aponta-se que a indenização devida a título de responsabilidade civil em caso de execução pelo equivalente deve se pautar pelo interesse positivo.</p><p><strong>Palavras-chave</strong>: Execução pelo equivalente. Resolução.</p><p><strong>Abstract</strong>: This article is based on a critical bibliographic review and under the logical-deductive method to present an analysis of execution by the equivalent in face of absolute default. It highlights that, upon an absolute default, the creditor has the potestative right to opt for a resolution of the obligation or for the execution by the equivalent. In this case, the obligation relation is not broken and both parties keep liable to the contract and the creditor shall have the execution <em>in natura</em> of what is due and shall be entitled to the given guaranties for credit. It also shows that the equivalent is not mistakenly taken as losses and damages; it refers to distinct and independent sums due. Thus, there is the possibility of accumulation of the equivalent to the compensation penal clause and the right for the creditor to claim payment even in the presence of the non-remedy clause. In the end, it is stressed that the indemnity due to civil liability upon execution by the equivalent must rely on positive interest.</p><p><strong>Keywords</strong>: Execution by the equivalent.
